I knew that was coming when you said you and the little woman where buying the house......it blows doesn't it? I used to do real estate/rentals years ago..... it hasn't changed how much it bites @ closing. It's great to see ya though dark.... I hope other than the new curse word (I'm sure you've been saying variations of it since before closing) how's the new place?

Well, I'll tell ya all a story. Here is what happened. The guy who sold me the house had taken out a second mortgage for $35,000.00 and defaulted on it. So naturally the bank wanted to get their money. They gave him no option but to sell the house and pay up or they would foreclose on the house. That's where I came in but not exactly in that part of the story. They seller had first listed with a realty company called "Remax" For some reason that I do not know to this day, Remax did not list his house to the public. As a matter of fact they did not list it at all. So the seller did what he thought was best and went with another realty company and signed a listing agreement with them. They were called "Merit" The problem was that the seller signed the listing agreement with Merit before the contract was up with Remax. Basically he was cutting out Remax from selling the house, but do you blame him?? Remax was not listing it and he needed to sell it or he was going to lose everything! So then Merit listed the house and I bought it 10 hours after listing. This is when the trouble started, but my wife and I had no idea about everything I just mentioned above. Remax got soo pissed off that they were being cut out of the deal that they went behind all of our backs to the company that held the second mortgage and bought it. They did this right in the middle of escrow. I was suppose to have been in my house by Feb 14th but did not close until March 1st. Remax was basically not going to let the title go until they were paid whatever profit they felt they were entitled to from the seller because of the first listing agreement. They were trying to pass the buck to me and my wife and get us to cough up the extra money. Well that is illegal. It was not illegal for Remax to buy the second title, cause that happens all of the time. Titles change hands. But it was illegal for Remax to try and change the original agreement that the seller and I had signed and that was in escrow. Finally I called my Lawyer and he called Remax threatening a lawsuit. They backed down and the next day my house closed and I got the keys. --PHEW!!!!! Long story

OMG! No wonder! What a saga Dark.... I'm so glad things turned out for you and your wife... Having dealt with real estate agencies in the past I know how territorial they can be about that commission.... it's good for them they back down.... it looks as if their eyes were bigger than their stomachs.

Yeah, I think that they realized that their fight was not with me but with the seller. I also think that they knew I wouldnt win in court but at least I was stupid enough to take them there and suck up any profit margin they would have made. So they gave in ;D

Not to mention the bad press they would get in the process, which could possible cost them more in the long run...... even one lost commission from bad PR, would have not been worth it to them I'm sure. I'm so glad they backed down.
